Na temelju čl. 7. Statuta i odluke Skupštine, Hrvatski uljudbeni pokret iz Zagreba, Pete Poljanice 7, dne, 2. travnja 2010., nastavno daje sljedeće

PRIOPĆENJE

za javnost u Hrvatskoj i Svijetu

 

1. Dr. sc. Tomislav Dragun, predsjednik Hrvatskog uljudbenog pokreta, u životnoj je opasnosti. Na poticaj Ephraima Zuroffa, direktora Centra Simon Wiesenthal, izvjesni mu je Djindjimilović preko interneta poslao poruku da će biti likvidiran zbog svoje "sumanute ideje o postavljanja spomenika Anti Paveliću". Hrvatski uljudbeni pokret odmah je (6. listopada 2009.) podnio Tomislavu Karamarku, ministru unutarnjih poslova RH, odgovarajuću redarstvenu prijavu. Međutim, rezultata nema. U Policijskoj Upravi Zagrebačkoj rečeno nam je da su oni u stanju pronaći Djindjimilovića, ali da sve zavisi od Državnog odvjetništva RH, dotično od Mladena Bajića.

 

2. Hrvatski državni i politički vrh priklonio se Epfraimu Zuroffu, pa je – kako bi omeo otvaranje Spomen-područja Nezavisne Države Hrvatske i Trga Dr Ante Pavelića Poglavnika NDH u Zagrebu zakazano za 26. prosinca 2009. – hitno djelovao preko Vrhovnog suda RH (predsjednik Branko Hrvatin), te 23. prosinca 2009. (pred sam Badnjak) ishodio pravomoćnu osuđujuću presudu protiv dr. sc. Tomislava Draguna.

 

3. Naime, dr. sc. Tomislav Dragun je tijekom zadnjih 15-tak godina, bilo osobno, bilo kao predsjednik Hrvatskog uljudbenog pokreta, podnio preko 200 kaznenih prijava, optužnih prijedloga i tužbi protiv nositelja i izvoditelja sustavne pljačke hrvatskog gospodarstva, prvenstveno tijekom pretvorbe i privatizacije, koji se inače nalaze u samom hrvatskom državnom i političkom vrhu. Njegove kaznene podneske u potpunosti potvrđuju aktualna zbivanja i uhićenja zbog kriminala. Nu, kapitalci, još uvijek ne dolaze na dnevni red.

 

4. Pritisnut dokazima, u očaju, hrvatski državni i politički vrh kreće u odlučujući obračun s dr. sc. Tomislavom Dragunom. Na prijedlog Državnog odvjetništva RH, a slijedom Psihijatrijskog nalaza i mišljenja prof. dr. sc. Dragice Kozarić-Kovačić, KB "Dubrava" u Zagrebu, iz klana Stjepana Mesića, od 20. rujna 2006. Općinski sud u Zagrebu proglašava dr. sc. Tomislava Draguna neubrojivim i traži za njega "djelomično lišenje poslovne sposobnosti u pogledu poduzimanja pravnih radnji i poslova, zastupanja na sudu, pokretanja sudskih postupaka, podizanja tužbi i kaznenih prijava".

 

5. Na Stručnom konziliju Psihijatrijske bolnice "Vrapče" iz Zagreba nije prihvaćen zahtjev za "djelomičnim lišenjem poslovne sposobnosti u pogledu poduzimanja pravnih radnji i poslova, zastupanja na sudu, pokretanja sudskih postupaka, podizanja tužbi i kaznenih prijava" dr. sc. Tomislava Draguna". Općinski sud u Zagrebu to je potvrdio.

 

6. Tada hrvatski državni i politički vrh, panično uplašen, a realno ugrožen djelovanjem Hrvatskog uljudbenog pokreta i dr. sc. Tomislava Draguna (u rujnu 2008. Hrvatski uljudbeni pokret utemeljio je Časni lustracijski sud), stavlja u akciju "Plan B". Ažurira se jedan od brojnih kaznenih postupaka koji se bez rezultata vode preko deset godina protiv dr. sc. Tomislava Draguna.

 

7. Županijski sud u Slavonskom Brodu (K-32/04), sudac Mirko Svirčević, 8. siječnja 2009. dosuđuje dr. sc. Tomislavu Dragunu kaznu zatvora u trajanju 4 godine, jer je "poticao odgovornu osobu u pravnoj osobi (Mirjana Marinović, direktorica trgovačkog društva 'Brodvin' d.d. Slavonski Brod) na počinjenje kaznenog djela ostvarivanja 'protupravne imovinske koristi' kroz kupnju vlastitih dionica po cijenama većim od nabavnih". Ne ulazeći, zasad, u činjenično stanje (ne radi se o prodaji dionica, nego o zamjeni istovrsnih dionica), nužno je reći da ostvarivanje razlike pri kupo- prodaji dionica nije kazneno djelo predviđeno u Kaznenom zakonu RH, niti u međunarodnom pravu. Osim toga, ne postoji niti jedan dokaz koji bi potvrđivao da je dr. sc. Tomislav Dragun na bilo što poticao Mirjanu Marinović. I ona sama, sada pokojna, tijekom istrage, u dva navrata, odbila je to potvrditi.

 

8. Čl. 31. Ustava RH i čl. 7. Europske Konvencije za zaštitu ljudskih prava i temeljnih sloboda propisuju da nitko ne može biti optužen, niti osuđen, za čin koji po zakonu i međunarodnom pravu nije kazneno djelo.

 

9. Unatoč tomu, Vrhovni sud RH 23. prosinca 2009. (presuda I Kž 282/09-6) pravomoćno potvrđuje osuđujuću presudu Županijskog suda u Slavonskom Brodu za dr. sc. Tomislava Draguna. Vrhovni sud RH nije smetala činjenica da je jednom svojom ranijom presudom (u predmetu K-753/05 – Miroslav Kutle i "Globus Holding") već utvrdio da ostvarivanje razlike u cijeni pri kupoprodaji dionica nije kazneno djelo.

 

10. Lov na dr. sc. Tomislava Draguna bliži se kraju. U zatvoru, hrvatski državni i politički vrh tako misli, postat će bezopasan. Mrtva usta ne govore. Pritom pak zaboravljaju, da "mrtva usta" još uvijek nisu mrtva, a iako to budu – ostat će dokumenti.

 

11. Na pravomoćnu presudu Vrhovnog suda RH dr. sc. Tomislav Dragun odmah je reagirao. Zatražio je obnovu postupka (8.2.2010.), podnio ustavnu tužbu (11.2.2010.) i obratio se Europskom sudu za ljudska prava u Strasbourgu (30.3.2010.). Nu, narod mudro kaže: "Dok zec dokaže da nije vol …"

 

12. Radi toga dr. sc. Tomislav Dragun zamolio je 15. ožujka 2010. zakonom predviđenu "odgodu izvršenja kazne zatvora", koja inače može trajati do 20 mjeseci. Međutim, Županijski sud u Zagrebu na njegovu molbu dosad nije reagirao, iako je to morao učiniti u roku 3

 

dana. Navedeni su sljedeći razlozi za odgodu izvršenja kazne: a) zdravstveni (operiran karcinom debelog crijeva, dijabetes), b) radno-poslovni (kazneni postupci protiv pljačkaša hrvatskog gospodarstva, djelovanje Hrvatskog uljudbenog pokreta), c) sudsko-procesni (obnova postupka, ustavna tužba).

 

13. Ne udovoljavanje molbi dr. sc. Tomislava Draguna za "odgodom izvršenja kazne zatvora" praktično vodi gašenju Hrvatskog uljudbenog pokreta i njegovih aktivnosti, među kojima posebno navodimo: "Glasnik", internetski tjednik, koji se besplatno šalje na 30.000 e-mail adresa, "Ognjište", internetski mjesečnik, Časni lustracijski sud, Uljudbena hrvatska vlada, Okupljanje domoljubnih i državotvornih Hrvata, naklada knjižnice "Brlog" u okviru koje su dosad izišle dvije knjige: dr. sc. Tomislav Dragun: ZORISLAV KALEB, SUDAC, OVAKO KROJI PRAVDU i RATKO ŠĆEKIĆ, SUDAC, OVAKO KROJI PRAVDU.

 

14. U svrhu zaštite temeljnih ljudskih prava dr. sc. Tomislava Draguna Skupština Hrvatskog uljudbenog pokreta, održana dne 2. travnja 2010. donijela je odluku o utemeljenju Odbora za obnovu ovog sudskog postupka dr. sc. Tomislavu Dragunu. Glavni cilj Odbora je ishoditi što žurniju obnovu sudskog postupka u predmetu Županijskog suda u Slavonskom Brodu br. K-32/04.

ANNOUNCEMENT

1. The life of dr. sc. Tomislav Dragun, president of Croatian Cultural Movement, is in danger. Encouraged by the director of Simon Wiesenthal Centre, Ephraim Zuroff, a man called Djindjimilovic has sent him a note, via internet, which says that he (dr. Dragun) will be liquidated for his “crazy idea for erecting a monument to Ante Pavelic”. Croatian Cultural Movement has immediately (on October 6, 2009) filed a corresponding complaint with the office of The Minister of Internal Affairs of Croatia, Tomislav Karamarko. With no results, so far. Meanwhile, in the Central police station in Zagreb, we were told that they would be able to find this Djindjimilovic but it all depends on The Attorney general, namely Mladen Bajic.

 

2. Croatian state and political leadership sided with Ephraim Zuroff so, in order to hinder opening of memorial ground for Independent State of Croatia and Square of Dr. Ante Pavelic, head of ISC, in Zagreb planned for Dec. 26, 2009, took a quick and immediate action through the supreme court of The Republic of Croatia (president Branko Hrvatin), and on 23 December 2009 (a day before Christmas eve) obtained valid sentencing judgement against dr. Tomislav Dragun.

 

3. Namely, dr. Tomislav Dragun had, during last fifteen or so years, either personally, or as a president of Croatian Cultural Movement, filed over 200 complaints against crime, accusatory motions and complaints against carriers and executors of systematic plunder of Croatian economy, primarily during transformation and privatization, persons who are otherwise found at the helm of Croatian state and political top. His reports and complaints are wholly supported and verified by actual happenings and arrests of many persons in Croatia in connection with these crimes. But, still none of the bigwigs are amongst them.

 

4. Pressed by indisputable evidence, in despair, Croatian state and political top moves into a decisive settling of scores with dr. Tomislav Dragun. On the advice by the office of the attorney general and following psychiatric “findings and thoughts” of Prof. dr. Dragica Kozaric-Kovacic (from the clan of Stjepan Mesic), of 20 September 2006, Municipal Court in Zagreb declares dr. Tomislav Dragun incompetent and requests that he should be “partially stripped of ability to conduct any business activities in regards to undertaking of any legal maters and transactions, representations in court, staging any representations in court proceedings (i. e. representing himself), and initiating any criminal accusations”.

 

5. At the consultation of experts at the Psychiatric Hospital of “Vrapce” the decision of The Municipal Court in Zagreb, that dr. Dragun should be “partially stripped of ability to conduct any business activities in regards to undertaking of any legal maters and transactions, staging any representations in court proceedings, and initiating any criminal accusations” WAS NOT ACCEPTED. The municipal court in Zagreb confirmed it.

 

6. Then, Croatian state and political leadership, panic-stricken, and really imperilled by the actions of The Croatian Cultural Movement and dr. Tomislav Dragun (in September 2008 The Croatian Cultural Movement established a Venerable court of lustration) activates its “Plan B”, by updating one of numerous criminal procedures undertaken (without success) against dr. Dragun.

 

7. The district court in the city of Slavonski Brod (K- 32/04) –judge Mirko Svircevic pronounces a judgement sentencing Dr. Dragun to four years in prison, “because he had inspired an accountable person in a legal person Mirjana Marinovic, director of trading company “Brodvin Ltd.” of Slavonski Brod, to commit a criminal act for realization of ‘illegal proprietary gains‘ through purchase of her own shares at prices greater than their worth“.

Without getting into factual circumstances, at this time, (the discussion was not about sale of shares in question, but about barter for identical shares) it is necessary to say that realizing the difference by buying and selling shares is not a criminal act anticipated in The Penal Statute of The Republic of Croatia, nor in any part of International Penal Code. Besides, there is not a shred of evidence which would prove that dr. Tomislav Dragun has influenced Mirjana Marinovic (now decesed) in any way. Twice, during the investigation, she categorically refused to confirm such claim.

 

8. Article 31, Statute of The Republic of Croatia and article 7, of The European Convention for protection of human rights and fundamental freedoms state that nobody can be charged or sentenced for any deed which according to the law and international statute is not a criminal act.

 

9. Notwithstanding, on 23 December 2009, The Supreme Court of Croatia passed a valid judgement (# I Kž 282/09-6) validly confirms the sentence for dr.Tomislav Dragun by The District Court of Slavonski Brod . THE supreme Court of the Republic of Croatia was not bothered by the fact that in one of its earlier judgements # Kž 753/05 (Miroslav Kutle and “Globus Holding”) already confirmed that realization of difference in prices by buying and selling shares is not a criminal deed.

 

10. The hunt for dr. Tomislav Dragun is getting closer to the end. In prison, the Croatian state and political top thinks, he will become harmless. Dead mouth does not speak. But ..... they are forgetting that “dead mouth” still is not dead, and even if it dies - the documents will remain.

 

11. Upon hearing the verdict of The superior Court of The Republic of Croatia, dr. Tomislav Dragun reacted immediately. He requested renewal of proceedings of (8. 2. 2010.), and submitted a constitutional grievance (11.2. 2010.) and contacted European Court for Human Rights in Strasbourg (30. 3. 2010.). But, as our people wisely said “ Until a hare proves that he is not a ox ....”.

 

12. Because of that, on 15 March 2010 dr. Tomislav Dragun requested a, by law provided right, postponement of execution of jail sentence, (which otherwise can last up to 20 months). Notwithstanding, even though The District Court of Zagreb was bound by law to render its decision within 3 days of the receipt of such request, there was no reaction or acknowledgement from this court whatsoever. In his request for the postponement dr. Dragun stated following reasons:

 

a) Health reasons (Surgery of colon carcinoma and diabetes).

 

b) Business (Criminal proceedings against plunderers of Croatian economy, and operation of The Croatian Cultural Movement).

 

c) Legal - procedural (renewal of prior court process and constitutional grievance).

 

13. Refusal by the court to honour dr. Dragun’s request for postponement of of the enforcement of the jail sentence, practically leads toward extinguishing of the Croatian Cultural Movement and all its activities, such as: Internet Weekly “Glasnik” which is, free of charge, transmitted to over 30,000 addresses, “Ognjiste” (monthly internet edition), court of honour and transparency (a watchdog against corruption and other crimes), Shadow Croatian Government of The Croatian Cultural Movement, Gathering of Patriotic and Nation-building Croats, and publishing/library “Brlog” (recently published two books by dr. Tomislav Dragun: “This Is The Way Judge Zorislav Kaleb Administers Justice“ and “This Is How Judge Ratko Scekic Administers Justice“.

 

14. With purpose to protect basic human rights of dr. Tomislav Dragun, members of The Croatian Cultural Movement held a meeting on 2 April 2010, and passed a resolution to establish a Committee for new trial against dr. Tomislav Dragun. Main goal of this Committee is to bring about hasty renewal of the case # K-32/04 of The District Court in Slavonski Brod.
